Kleffman v. Vonage - No Oral Argument


Kleffman v. Vonage was a class action complaint filed in California.  The Central District of California dismissed on (among others) preemption grounds.  Previous post here.

The case is on appeal to the Ninth Circuit.  Oral argument was scheduled to take place in December.  The other day, the Ninth Circuit issued an order [pdf] finding the case appropriate for submission without oral argument.  I'm not sure whether the court thinks the appeal lacks merit, or that this is an easy case.  Also, I wonder if we'll see competing Ninth Circuit pronouncements on the preemption issue?
