Dec 13, 2008 Links/Odds and Ends


1.  Canada / SpamProfessor Geist previously posted on whether Canada is a spam haven ("Lawless Canada Emerging as a Spam Haven").  Now we see that "Canada Might Get an Anti-Spam Law for Christmas": [Deliverability.com].

2.  Top 10 Lists:  This one's fun:  "What are the Top 10 Internet Cases of 2008?"  [Internet Cases]. 

3.  ISPs / Privacy:  CU Law Professor Names ISPs the Gravest Threat to Personal Privacy [Rocky Radar].  I don't think I agree - I would place social networks above ISPs.  ISPs are like cable companies (many actually are) - these companies haven't egregiously violated our privacy over our viewing habits, there's no particular reason to think they will over our surfing and emailing habits.  The penalties can be steep and it's just not worth it.  In contrast, social networks are young and aggressive and don't really have the pre-existing regulatory institutional framework that cable companies and telcos deal with.  (Of course, assistance in govt. spying represents a huge exception and counterpoint to this, so take it with a grain of salt!)

4.  Spam / First Amendment:  Virginia seeks reinstatement of its spam law (Virginia appeals the Virginia Supreme Court decision finding that Virginia's spam law violated the First Amendment) [Legal Satyricon].  I think they've got a reasonable chance of securing review.  (Previous post here.)  The decision combines several juicy First Amendment procedural issues - facial challenges/standing/overbreadth (etc.). 

5.  Email Etiquette
