Unsolicited Marketing Extravaganza in the Ninth Circuit
The Gordon v. Virtumundo case is set for oral argument in Seattle in early December. Someone emailed to say that Kleffman v. Vonage is set for argument in Pasadena on the 10th.
Kleffman was a class action brought under the California spam statute, which was dismissed. Earlier post here.
A slew of interesting cases on appeal in the Ninth Circuit in this area:
- Gordon v. Virtumundo (standing/preemption under CAN-SPAM)
- Satterfield v. Simon & Schuster (unsolicited text messages)
- Kleffman v. Vonage (unsolicited email/preemption)
- Asis v. Azoogle (lead generation/CAN-SPAM)
