Brosnan v. Alki Mortgage: Dismissed


Plaintiff John Brosnan filed a CAN-SPAM complaint against Alki Mortgage.  The court on its own motion dismissed for failure to satisfy standing requirements (and allege harm from the email(s) in question).  Plaintiff filed an amended complaint leaving out Alki Mortgage but adding a slew of doe defendants. 

The court dismissed the case with prejudice (access the order in pdf here).  Brosnan sent in a letter to the court requesting reconsideration (access the letter in pdf here).  The court denied reconsideration.

No word as to whether Alki Mortgage can recover fees, since it proceeded pro se.

I'm not sure whether Brosnan's pro se status is some sort of sign that it's becoming more difficult to find a plaintiff's lawyer to take on a CAN-SPAM case which potentially suffers from a Virtumundo problem?
