Quick Links

  1. Evan Brown (Internet Cases): CD-ROM is not a computer (stop trying to stretch the bounds of the Computer Fraud and Abuse Act!).
  2. ars technica:  CAN-SPAM violations cost online ad firm $2.9 million ("Online advertiser ValueClick and its subsidiaries were charged with using deceptive e-mails, banner ads, and pop-ups to drive traffic, as well as a failure to secure customers' financial information. The settlement is the largest in CAN-SPAM's five-year history, says the FTC, and bars the companies from any further violations.").
  3. Word to the Wise:  e360 v. Comcast: part 3 (Comcast fires back, part 2) (I personally will be quite disappointed if this case settles . . . .).
  4. Impulse Media pleadings here (govt.'s trial brief in .pdf) and here (defendant's trial brief in .pdf).  Another spam prosecution in the Emerald City - it's always tough to tell from something like a trial brief, but I wasn't particularly blown away with the government's case here.
  5. Seattle PI/Todd Bishop:  2 major spam cases end up in Seattle (the article mentions spamnotes).
  6. BNA's TechLaw:  Turnitin.com Lawsuit Yields Rulings on Browsewrap Contracts, Fair Use of Copyrighted Expression (not directly on point for this blog, but interesting nonetheless).
  7. StorefrontBacktalk:  What Did Hannaford Know and When Did it Know it? (data breaches that no one really seem to care about . . . although I'm sure a few class action lawyers are licking their chops).
