T-Mobile TXT Class Action Filed

Marco Zaldivar, on behalf of himself and all others similarly situated v. T-Mobile USA Inc., C07-1695 R

Class action complaint for breach of contract. The plaintiff was a T-Mobile wireless subscriber. The defendant failed to disclose that text messaging is an additional "mandatory" service. The subscriber cannot avoid being charged for unwanted text messages by not opening or responding to the messages or turning off the phone. The class consists of all current and former non-business T-Mobile wireless subscribers in the United States who have been improperly charged and paid text messaging fees.

The lawsuit was filed by Jeffrey D Friedman of Coughlin Stoia.
