The Gordon Problem?
You know you've reached new heights when an actual doctrine is named after you.
I'm referring to the problem James Gordon encountered when he tried to sue Virtumundo - namely, he was not able to articulate any harm he suffered (or he didn't suffer any, depending on how you look at it). Not only did the court grant summary judgment against him, it assessed a fee award of upwards of 100,000 against him.
What's happened since then? His lawyers withdrew, and Gordon is proceeding pro se in the Ninth Circuit. (I haven't tracked down a copy of the briefs he's filed, but if anyone has a copy I'm glad to post it.)
