Big CAN-SPAM Ruling


The Western District of Washington issued an extremely significant CAN-SPAM ruling today.

I won't have a chance to read it for a bit, but you can access it (in pdf) here - it addresses the standing/provider of an "internet access service" issue, and grants summary judgment across the board.

This is a big one!

Update:  wow I just happened to see the last paragraph, which says that attorney's fees will likely be awarded.  If this does not take the wind out of the sails of the anti-spammers I'm not sure what will.
