Quick Looks at the WA DWT and Hang-up and Drive Bills


Two Washingtons state bills dealing with driving while texting/phoning are expected to pass.  You can access what I think are the latest versions in pdf here (S3025 – texting) and here (SB5037 – driving). 

Driving While Texting:  the Driving While Texting bill reaches a driver who "sends, reads, or writes a text message" while driving.  Entering a phone number or name in a phone "for purposes of making a phone call" is excluded.  The bill does not make this an independent violation but allows officers to cite people when they are otherwise cited for another traffic infraction.  How people are not going to be able to get out of this by arguing that they were just entering in someone's phone number to make a call I have no idea.  It's probably a bad idea to have a law that is focused heavily on "texting".  What about emails?  What about reading the paper?  Make up?  Leaning over to scold your kid?  I'm not a big fan of this one.

Hang up and Drive!:  this bill reaches people who "operat[e] a moving motor vehicle while holding a wireless communications device to his or her ear."  There are certain exceptions (such as if you are reporting an emergency) but the basic violation occurs if you are driving while the phone is glued to your ear.  I haven't thought through where and how the bill could be cleaned up but I like the general idea.
