OK Court: Misleading Statement in Email Must Actually Cause Injury
Reasonable basis posts another decision involving Mummagraphics [link]. This time an Oklahoma appellate court holds under the Oklahoma email law that "[the] false, malicious, or misleading information [in an email must] be the cause of the plaintiff's injury."
As Reasonable Basis notes, "the only injury Mummagraphics alleged was receiving and processing the email. Even if the information in the messages had been true the claimed injury would have occurred."
I have a feeling we may see more of that first phrase ("the only injury [plaintiff] alleged was receiving and processing the email") in the future.
