OK Court: Misleading Statement in Email Must Actually Cause Injury


Reasonable basis posts another decision involving Mummagraphics [link].  This time an Oklahoma appellate court holds under the Oklahoma email law that "[the] false, malicious, or misleading information [in an email must] be the cause of the plaintiff's injury." 

As Reasonable Basis notes, "
the only injury Mummagraphics alleged was receiving and processing the email.  Even if the information in the messages had been true the claimed injury would have occurred." 

I have a feeling we may see more of that first phrase ("
the only injury [plaintiff] alleged was receiving and processing the email") in the future.
