Acxiom [Data Breach] Follow Up


MercuryNews reports that the 8th Circuit upheld a conviction for theft/breach of data housed by Acxiom.   The article contains this little bit that worth noting:
Prosecutors said Levine had permission to access part of Acxiom's database but that he used decryption software to obtain passwords and go beyond his authorized access. Data stolen included names, telephone numbers, street addresses and e-mail addresses, along with highly detailed demographic information.
You can access a [pdf] copy of the opinion here.  You may recall that plaintiffs who sued Acxiom lost on the theory that they did not suffer any injury.  That result is tough to swallow when you realize that Acxiom alleged in the criminal case that they had been harmed, and that the perpetrator had permission to access a part of Acxiom's database.
