A Myspace Crush Harassment Doth Not Make


Thanks for Prof. Goldman for the tip on this case - reading it made my day:  People v. Rodriguez, 2008 NY Slip Op 28123 (April 4, 2008).  The three sentence summary:

Lovestruck teenager sends crush a few MySpace messages.  The teenager is charged with "Aggravated Harassment".  Court holds that "unrequited teenage love is not a crime." 

The opinion is an entertaining read, and cites, among other authorities, Romeo and Juliet and Chaplinsky v. State of New Hampshire.  Behind the scenes message to prosecutor:  find something better to do with your time.
